Appeals & Variances

New Brighton Borough provides for an appeals procedure for all building codes and adopted municipal ordinances. This procedure is put in place so that any person directly affected by the decision of the Building Code Official or Zoning Officer, or of a notice issued pursuant to any municipal ordinance, has the right to appeal to the appropriate board.

Appeals of the provisions of the Uniform Construction Code are heard by the Beaver County Regional Council of Governments Board of Appeals. Appeals to this Board shall be in on a Board issued application, state the ground upon which the appeal is based, and be accompanied by the required processing fee. The Board of Appeals meets only as required for action on an appeal application. The Board of Appeals does not consider appeals to the accessibility provisions of the UCC. Only the Pennsylvania Department of Labor and Industry can hear an accessibility appeal. Such appeals to Labor and Industry must use the Department's standard application.

 

All other appeals of adopted Borough ordinances, such as the property maintenance code or Rental Registration Ordinance, are heard by the New Brighton Code Hearing Board. This Board meets the third Monday of each month, as needed. Appeals to this Board shall be in writing on an appeals application, state the ground upon which the appeal is based, and be accompanied by the required processing fee.

 

The New Brighton Zoning Hearing Board considers appeals of the Zoning Ordinance and zoning variance requests. This Board also meets on the third Monday of each month, as needed. Petitions for zoning variances shall be made using the Borough's zoning variance application. All other zoning appeals shall be in writing, state the ground upon which the appeal is based, and be accompanied by the required processing fee.
